Wednesday June 11, 2014 Regular Board Meeting
7:00pm


The regular Board Meeting of The Village of Hillcrest was opened with the Pledge of Allegiance. Present and answering roll call were Trustees Rick Rhoads, Steve Dodson, Rich Elliott, Dave Long, and Jeanie Sparacino. Also present were President Kim Whalen, Attorney Paul Keller, Treasurer Penny Payton, and Village Clerk Patty Moreno. Trustee Randy Salsbury was absent.

A motion was made by Trustee Sparacino, seconded by Trustee Elliott to approve minutes from April 16, 2014 Special Meeting and May 14, 2014 Regular Meeting as presented. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.


Treasurer Penny Payton reported that the cash deposits as of May 31, 2014 are as follows: General Fund $369,630.68, Motor Fuel Tax $115,796.56 unencumbered balance, Utility Fund $159,344.45 and Capital Project Funds $25,007.29.

A motion was made by Trustee Elliott, seconded by Trustee Long to approve the Treasurer’s Report as presented. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.

A motion was made by Trustee Rhoads, seconded by Trustee Long to approve the payment of bills as amended. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.


DEPARTMENT REPORTS

Administration- President Whalen stated that she would like to thank Doug Fischer for once again donating mulch to the Village.

President Whalen reported that the clerk’s hours were going to be increasing and the Treasurer’s hours were going to be decreasing all office hours would remain the same with the exception of Saturdays. President Whalen stated that the Village Hall hours on Saturday would be from 8am to 12am.

President Whalen reported that the Village is no longer doing animal control and calls or concerns regarding animals would need to be directed to Ogle County Animal Control.

President Whalen stated that advised by engineer Jim Sparber the board should create a Utility Advisory Committee to handle all question or concerns coming from residents in regards to the sewer project. President Whalen stated that she has asked Trustee Elliott to be in this committee and Meridith Arjes has expressed interest in also being in this committee. President Whalen asked the board’s support in making this committee.

A motion was made by Trustee Sparacino, seconded by Trustee Long to approve in creating a Utility Advisory Committee with members being Trustee Rich Elliott and resident Meridith Arjes. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.
Ordinance- Trustee Dodson had nothing to report for the Ordinance Department.

Finance- Trustee Sparacino had nothing to report for the Finance Department.

Water- Trustee Elliott had nothing to report for the water Department.

Economic & Community Development- Trustee Long had nothing to report for the Economic & Community Development Department.

Streets & Grounds- Trustee Rhoads reported that while the contractor was installing the insulation he found a leak in the roof of the Village Hall which the Village will be looking in to.

Trustee Rhoads reported that the proposed maintenance of the Streets has now been completed, and due to the cost being lower than expected he would like to research the opportunity of doing maintenance on other much needed street maintenance. Trustee Rhoads stated that he would like to get rid of the blue grand Victorian and would like this put on the agenda for vote next month.

Village Attorney- Village Attorney Paul Keller had nothing to report at this time.


NEW BUSINESS

2014 MFT Street Maintenance
Engineer from Baxter & Woodman provided the board with a Memo stating the partial payment in the amount of $66,856.18 to Martin & Company Excavating for work completed in connection to the 2014 Street Maintenance Program.

A motion was made by Trustee Rhoads, seconded by Trustee Sparacino to approve partial payment in the amount of $66, 856.18 to Martin & Company Excavating. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.

Approval of Prevailing Wage Ordinance
A motion was made by Trustee Rhoads, seconded by Trustee Long to approve the Prevailing Wage Ordinance. Roll call vote: Rhoads; yes, Dodson; yes, Elliott; yes, Long; yes, Sparacino; yes. Motion carried.

PUBLIC COMMENT

Terry Gregory, 208 Roy Ave, asked the board if the board had heard the definite date of when Regional Ready Mix is relocating.

President Whalen stated that she had not spoken with Owner of Regional Ready Mix Scott Watson since she spoke with Mrs. Gregory last time.

Mrs. Gregory would like to clarify that Mr. Watson stated in the newspaper that the EPA had been contacted and they were turn down three times with complaints. Mrs. Gregory stated that those complaints came from her a public citizen trying to get the help that they needed. Mrs. Gregory provided the board with proof of Regional Ready Mix having problems with the EPA and they are compliant. Mrs. Gregory stated that she wanted the board to know that the time and the effort she has put in to this problem for eight years is overwhelming, and depressing. Mrs. Gregory stated that the prior board was notified of Regional Ready Mix was going to be moving to the current location temporarily and no board member questioned Mr. Watson. Mrs. Gregory stated that if Regional Ready Mix would be located in Windover the board would not have allowed them to continue operating in that location. Mrs. Gregory stated she feels as if the residents on the area of the current location of Regional Ready Mix do not matter enough to this community that they have suffered for eight years. Mrs. Gregory stated that she is once again asking when the board is going to go to Regional Ready Mix owner Scott Watson and give them a date of when they need to be relocated to the new location. Mrs. Gregory stated that she would like to enjoy the rest of this summer since she has missed eight summers. Mrs. Gregory stated that she has had several conversations with President Whalen and Attorney Paul Keller in regards to the violations of Regional Ready Mix. Mrs. Gregory asked if Regional Ready Mix getting any tax abatement at this time.

President Whalen stated that Regional Ready Mix is not receiving Tax abatement at this time.

Mrs. Gregory asked when the tax abatement start.

Attorney Keller stated that the Tax rebate for calendar year 2014 but the agreement has not been fully executed since Regional Ready Mix has not relocated.

Mrs. Gregory asked if the Village was going to wait for owner Scott Watson to tell them when they are going to be relocating.

Attorney Keller stated that he is has not had contact with Mr. Watson or his Attorney. Mr. Keller stated that there is not a deadline to have Regional Ready Mix to relocate and if they have not completed construction on the new site then it is physically impossible for them to move.

Mrs. Gregory stated that it is physically impossible for Regional Ready Mix to move because they are not moving they are too busy working. Mrs. Gregory stated that the residents were told in 2013 that Regional would not operate in their current location in 2014 and now it’s June and they are still operating in their current location.

Attorney Keller stated that the Village’s legal authority is very limited in this situation. Attorney Keller asked what Mrs. Gregory would like the Village to do.

Mrs. Gregory stated that she would like the Village to notice that the residents are still living in that hell.

Attorney Keller stated that the Village is aware of the situation.

Mrs. Gregory stated that then why go through the trouble and the cost of a contract if it cannot be fulfilled.

Attorney Keller stated that the contract has never actually been signed by the property owner.

Mrs. Gregory stated that she is very frustrated and is tired of this situation and would like to ask the board to take the health and welfare of the resident above the revenue.

Leonard Cradduck, 202 Roy Ave, stated that when it gets windy and Regional Ready Mix trucks go by it gets really dusty and they are violating a lot of the Village ordinances.

Trustee Rhoads asked if the Village had a date of the fourth of July weekend that Regional Ready Mix was going to relocate.

Attorney Keller stated that he did not have that conversation with anybody.

Trustee Rhoads stated that the date was brought up in the last meeting. Trustee Rhoads stated that the board can start enforcing the ordinances more. Trustee Rhoads stated that if Regional Ready Mix does not have the time to do the construction on their new site then they should hire someone to do it.

President Whalen asked Trustee Rhoads if he would be willing to work with Trustee Dodson in writing out ticket violations to help enforce the ordinances.

Trustee Rhoads stated that this would be fine. Rhoads asked if any complaint coming into this village should be going to the Ordinance Trustee.

President Whalen stated that if there is a resident that comes in and wants to talk to the Village President instead of the Ordinance trustee she will resolve the issue. President Whalen stated that any board member and address a complaint not just the Ordinance Trustee.

Trustee Rhoads stated that if a trustee asks for a copy of all complaints that have come in.

President Whalen asked Trustee Dodson if he had asked for any complaints and was denied.

Trustee Dodson stated that he had asked for one complaint twice and has not received anything.

President Whalen stated that all trustees have the authority to ask for all complaints. President Whalen asked the Village Clerk if trustee Dodson had asked for any complaints.

Village Clerk Patty Moreno stated that trustee Dodson had indeed asked for one complaint regarding Regional Ready Mix.

Attorney Keller stated that any trustee can write an ordinance violation but there is a proper form that it has to be done on.

Rhoads stated that if the police department could train them on how to write ordinance violations.

Attorney Keller stated that the police department could train the trustees.

Village Clerk Patty Moreno stated that she would like to clarify that if she did not give Trustee Dodson the complaint regarding Regional Ready Mix it was not because she just did not want to give it to Dodson it was because she was told that any complaint filed against a Business should go to the Village President.

President Whalen stated that she did not realize Dodson had been asking for the complaint but she would still like to have a copy so that she is informed of the situation.
Moreno stated that this situation was making her look bad as if she was not allowing Trustee Dodson to have this complaint and this was not the case. Moreno stated that she was following direction.

There was discussion of the paper work that is missing on how Regional Ready Mix was allowed to operate at the current location.

President Whalen stated that she would like to clarify that if any trustee gets a phone call regarding a complaint there is no need to call Trustee Dodson if they can solve the issue. President Whalen stated that any trustee can resolve a complaint.

A motion was made at 8:40pm to adjourn by Trustee Long, seconded by Trustee Sparacino. All in favor say I. All I’s.
